[e4]news open-sot announcer says "watching out for you, we are learning more at this crash each hour. what we know right now is that plane came from cuba and slid off the runway into the st. john river in jacksonville florida. according to reports from fire crews on scene there were 142 people on board th plane and everyone is accounted for and alive. 21 people taken to the hospital, but nothing life threatening. we are now hearing from passengers on that plane. the flight was delayed. we didn't know why flight was delayed for about four hours. when it arrived the people who were disembarking explained to us that the air conditioning in the plane had not worked. they didn't fix it. they flew it that way anyway and they were pretty universally miserable. so none of us were looking forward to getting onto the plane. we are still waiting to learn why the plane skidded off the highway. we will continue to update you with this developing story. a man was arrested lmorning i'm. police say that driver is suspected of driving under the influence and fleeing the scene of a hit and run. the driver first hit a truck on highway 62 near linn road. the owner of the truck that was hit said the suspect fled the scene. so she followed the car with another witness behind her. both vehicles followed the suspect into a subdivision. you can security footage of all three of the cars driving through the neighborhood. that's when the suspect hit another vehicle, this time it was a parked limo. at this point the driver got out of his vehicle and tried to flee on foot. but those witnesses stopped him as police arrived. the women initially hit had to go to the hospital to be treated for injuries. a california wod justin graham-yaeger is facing one count of murder. police don't yet know the motive behind this murer. early friday morning , medford police got a call of disturbance just after 4:30. when they got the room, no one answered the door so police forced entry. that's where they found 23-year- old homicide victim, sierra clemens. a polce k-9 helped track down the male suspect down the street from the tiki lodge, after getting a search warrant, oregon state forensics did an investigation of the room. "it is a little scary, you have to be careful. you it's a little scary for the children." the jackson county medical examiner was on scene as well as several detectives. police are still investigating the exact cause of the death the klamath c23 year old cheney hardt learned he will spend the rest of his life under psychiatric review. he pleaded guilty to murder, but for insanity. this sentence is not common in oregon's legal system. eve says, "very unusual, i think i've had in my career probably 4 that i remember, and this would be the fifth and i've been practicing for 21 years." last may's gruesome attack left hardt's mother dead and his father in the hospital. costello tells me both the defense expert and the county's expert found hardt to be mentally ill both during parts of his life and the attack. hardt will be committed to the psychiatric security review board for life. costello says the standard to declare someone 'legally insane' is very high and it doesn't happen often. it's highly unlikely he'll ever leave. if anything - costello says there's a chance he could be moved to a less strin-gent facility. [e14]gas station controversy-intro hundreds of peoplsays, "neighbos tell me they have several concerns if construction does move forward on this lot, including more traffic in the area, decreased safety in their homes and some are even woried about a hawk that's been nesting on this property for more than five years." here's a look at the tree this hawk calls home... right now, the hawk is nesting. and nesting season won't be over until august. gary sumrak has lived nearby for about 25 years. and he says this hawk has lived here for years. gary says, "they can't touch that property until that hawk leaves that nest which probably won't be until probably after july." sumrak is right. it's illegal to cut down a tree intentionally when a bird is nesting in it. matt says "we have no intent of disturbing that property until after nesting season." and hawks are federally protected and require special removal. after nesting season, a landowner must get a permit from the u.s. fish and wildlife service to remove the hawk from the property. "there's even been discussion with the owner of offering a nesting pool on site that the hawk could renest. i'm sure he would be happy to do that but we don't know that it would be successful at this point in terms of what the hawk actually renest, i'm sure he would be happy to do that but we don't know that it would be successful at this public hearing today. nat: "i would like to express why i oppose this project." the council didn't come to a conclusion on whether or not they will approve the project. the next hearing is scheduled for may 17th. in medford, cassidy delamarter. following up on the fireworks orindance in medford. people in medford will face higher fines for approved new firework rules. using illegal fireworks now is a 25-hundred dollar fine. it used to be 250 dollars. the time period to use fireworks was also reduced from a 14 day span. you can now only set them off between july first and july 6th.
