Nicholas McGuffin released from prison

McGuffin was convicted of killing Leah Freeman, who was 15 when she died in 2000.

COOS BAY, Ore. – Nicholas McGuffin, who was convicted in 2011 of killing 15-year-old Leah Freeman in Coos County, walked out of prison a free man Tuesday night.

Jennifer Black of the Oregon Department of Corrections confirmed that McGuffin was released from South Fork Forest Camp in Tillamook County east of Portland.

McGuffin has been in prison since he was convicted of killing Freeman in 2000. However, a judge overturned the manslaughter conviction earlier this month, citing evidence that shows DNA from an unknown man was discovered on Freeman’s shoe during the investigation.

Court documents claim that at the time of the trial, McGuffin's defense lawyer did not hire an expert to analyze the DNA report, which would have revealed the presence of the unknown DNA.

Coos County District Attorney Paul Frasier said on Tuesday that the Oregon Department of Justice would not appeal the decision for McGuffin to receive a new trial.

Frasier issued a statement, saying, “After having consulted with members of the original investigating team and the family of Ms. Freeman, I have decided not to pursue a new trial in the case. As I have decided to not seek a new trial, I am required to dismiss the case against Mr. McGuffin.”
