MEDFORD, Ore. — The driver involved in a fatal crash with a bicyclist is not facing charges. The accident happened on Riverside Avenue in Medford back in October.
Medford Police say 23-year-old Cody Smith made a right turn into a business. At the same time, Gary Tuer’s electric bike hit the rear of the car. 66-year-old Tuer was unconscious at the scene and died at the hospital.
The Jackson County District Attorney’s Office announced Thursday afternoon that there isn’t enough evidence to charge Smith with reckless or criminally negligent conduct.
