UPDATE: Robert Smith II stands accused of performing a drive-by shooting on multiple people while his two young children were in the car, according to a statement from law enforcement officers who responded to the scene.

The same statement indicates that Smith allegedly fired six shots from a .40 caliber handgun out of his driver's-side window, hitting victim David Lamburth multiple times in the back and legs. Nearby were three other people, who are also being considered targets of the shooting.

Smith's 3-year-old and 1.5-year-old children were apparently in the car during the shooting, according to police. The statement says that Smith fled the scene, but was later arrested and "admitted his involvement."

The District Attorney's office now aims to charge Smith with four counts of Attempted Aggravated Murder with a Firearm, one count of Attempted Murder with a Firearm, and one count of Assault in the First Degree with a Firearm. However, those charges await a Grand Jury before the case can proceed.
